Certification Introduction:

The European Commission officially released the General Product Safety Regulation (GPSR) (EU) 2023/988 on May 23, 2023. This regulation will officially take effect on June 12, 2023, and will be enforced on December 13, 2024, replacing the old General Product Safety Directive (GPSD, 2001/95/EC). Directives 87/357/EEC and 2001/95/EC will be repealed from December 13, 2024.

1. What is the General Product Safety Regulation GPSR?
The European General Product Safety Regulation (GPSR) is a new regulation that aims to ensure that all consumer products on the EU market are safe and is required for most non-food consumer goods sold in the EU and Northern Ireland. requirements.

The GPSR provides a safety net for products or risks not regulated by other EU legislation. This secure network feature means EU consumers are always protected from dangerous products, now and in the future.

 

2. New requirements and changes

GPSR is a further amendment and improvement to the previous General Product Safety Directive (GPSD), adding new compliance requirements. Specifically, important adjustments have been made to the person in charge of product compliance, product labels, certification documents, communication channels, etc.

Compared with GPSD, GPSR has increased requirements for compliance officers, including resellers, authorized representatives, fulfillment service providers, online marketplace providers, and entities other than manufacturers who make substantial modifications to products.

One of the biggest changes in the new policy is the mandatory requirement for EU representatives, which means that all sellers selling EU products must designate an EU representative responsible for complying with GPSR requirements.

 

3. Which sellers will be affected?
Most Amazon European sellers will be affected by this regulation. This includes the sale of goods and the sale of non-food consumer goods in the EU and Northern Ireland.

However, the following product types are excluded:
Pharmaceutical products for human or veterinary use;
food;
Animal food;
Living plants and animals (including enclosed genetically modified organisms and genetically modified microorganisms, as well as animal and plant products directly related to the future reproduction of animals and plants);
animal by-products and derivatives;
plant protection products (e.g. pesticides);
Ride or travel equipment for consumers, provided that the equipment is directly operated by the service provider within the scope of transportation services provided to the consumer and not by the consumer himself;
airplane;
antique.

 

4. How should sellers complete compliance?
Sellers should ensure that all goods sold in the EU & Northern Ireland comply with existing labeling and traceability requirements. Sellers need to provide an EU responsible person for the products they sell.
The following people can become EU Responsible Persons:
① Manufacturer (if registered in the EU);
② Importers registered in the EU;
③ The authorized representative of a company registered in the EU shall be designated in writing by the manufacturer or brand as the person in charge;
④ A delivery service provider registered in the EU that is responsible for delivering goods.

Make sure product labels include the following information:
① Contact information of the EU responsible person (postal address and email address URL);
② Warning and safety information (please use the language of the country of sale);
③ Label of product type, batch or serial number or other elements;
④ The postal address and email URL of the manufacturer and importer (if applicable), and the postal address or email URL of the single point of contact who can be contacted (if different from the above address).
Make sure to display the following information in online product information (product details page):
① The name and contact details of the EU responsible person, including postal address and email address URL;
② Manufacturer’s name and contact details, including postal address and email address URL;
③ In addition to the labeling and marking information that must be displayed in compliance with applicable EU product safety and compliance legal requirements, warning and safety information should also be displayed, and ensure that these information are in the language of the country of sale.
